2. Description of the Service
The Service is an online educational product consisting of video lessons, downloadable resources, and a private student dashboard. Access is sold as a one-time lifetime purchase at $47 USD unless otherwise stated at checkout.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding contract. By using the Service, you confirm that you meet these requirements.
4. Financial and educational disclaimer (not investment advice)
The course is for general educational and informational purposes only.
- We are not a regulated investment firm, broker, or financial advisor under Estonian or EU law (including MiFID II).
- Content is not personal investment advice, a recommendation, or an offer to buy or sell any financial instrument.
- Trading and investing involve substantial risk of loss. Past performance, examples, and backtests do not guarantee future results.
- You are solely responsible for your decisions. Consult a licensed professional for advice tailored to your situation.
- If content references leveraged products (e.g. CFDs), you may lose more than your deposit; such products are not suitable for all investors.
5. Account registration and security
You must provide accurate information when registering. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at contact@berglinelabs.com if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms, abuse the Service, or share access credentials with others.
6. Payment
Payments are processed securely by Stripe. Prices are shown in USD and include applicable taxes where required by law. A successful payment grants lifetime access to the course content available at the time of purchase and future updates we choose to include in the product, unless we state otherwise.
You receive an electronic confirmation and access to the dashboard after payment is completed. We do not store your full payment card details on our servers.
7. Digital delivery
The course is digital content not supplied on a tangible medium. Access is provided electronically through your account on our platform immediately after successful payment and account activation, unless a technical issue prevents delivery.
8. Right of withdrawal (EU consumers)
If you are a consumer in the European Union or European Economic Area, you generally have a 14-day right of withdrawal under the EU Consumer Rights Directive and the Estonian Consumer Protection Act (Tarbijakaitseseadus) for distance contracts.
Digital content exception: For digital content delivered immediately, the right of withdrawal does not apply once you expressly consent to immediate delivery and acknowledge that you lose your withdrawal right, in accordance with Article 16(m) of Directive 2011/83/EU.
By completing your purchase and accessing the course dashboard, you request immediate delivery of digital content and confirm that you understand you lose the statutory withdrawal right once access begins, to the extent permitted by applicable law.
If you have not accessed the Service and withdraw within 14 days in a manner permitted by law, contact us at contact@berglinelabs.com. Approved refunds are processed via the original payment method where possible.
Section 8 applies only if you qualify as a consumer in the EU/EEA. Customers outside the EU/EEA are not entitled to the EU statutory withdrawal right unless required by their local mandatory law.
9. Refunds
Except where mandatory consumer law requires otherwise, all sales are final once digital access has been granted under Section 8. We may, at our sole discretion, issue refunds in exceptional circumstances. Chargebacks made in bad faith may result in immediate revocation of access.
10. Community guidelines
We may host private groups, chats, or forums. Respectful behavior is required. We may remove any participant who violates community standards without refund.
Respectful conduct also applies to participation in competitions and leaderboards. Abuse, manipulation, or misrepresentation of earnings may result in removal.
11. Intellectual property
All course videos, text, graphics, downloads, branding, and software forming part of the Service are owned by or licensed to Bergline Digital OÜ. Your purchase grants a personal, non-exclusive, non-transferable, revocable licence to access the content for your own private learning.
You must not:
- Copy, record, redistribute, resell, or publicly share course materials
- Use the content to create a competing product or service
- Remove copyright or proprietary notices
- Share your account or dashboard access with third parties
12. Acceptable use
You agree not to misuse the Service, including by:
- Attempting to bypass access controls or download restricted content at scale
- Uploading malware or interfering with platform security
- Harassing staff or other users in community channels
- Using the Service for unlawful purposes
13. Availability and changes
We may update, reorganize, or improve the course. We do not guarantee uninterrupted access. Reasonable maintenance or third-party outages (including video hosting providers such as YouTube) may occur.
Material changes to these Terms will be posted on this page with an updated date. Continued use after changes constitutes acceptance where permitted by law.
14. Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties that the Service will be error-free or that the content is suitable for your individual financial situation.
15. Limitation of liability
Nothing in these Terms limits liability where limitation is not permitted under applicable law (including mandatory Estonian/EU consumer rights).
To the extent permitted by law, we are not liable for indirect losses, lost profits, or trading losses. Our total liability for any claim relating to the course is limited to the amount you paid for access, except where a higher minimum is required by law.
16. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service with reasonable notice where practicable. Sections that by nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.
17. Governing law and jurisdiction
These Terms are governed by the laws of Estonia, without prejudice to mandatory consumer protection laws of your country of residence in the EU/EEA.
If you are a consumer, you may bring proceedings in Estonian courts or, where EU law allows, in the courts of your country of residence.
EU consumers may use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution before a consumer arbitration body, but we will review good-faith complaints sent to contact@berglinelabs.com.
18. Personal data
We process personal data as described in our Privacy Policy in accordance with the GDPR and Estonian data protection law.
